Marketplace Terms of Service

1. Agreement and marketplace

These Terms govern use of crossyourarts.com, operated by Cross Your Arts LLC (“Cross Your Arts,” “we,” “us”). By accessing or using marketplace features or accepting these Terms, users agree to the applicable terms, subject to law. The marketplace connects buyers with independent approved sellers.

Additional applicable documents include the Privacy Policy, Seller Agreement, Seller Marketplace and Marketing Agreement, Seller Eligibility/Product Standards and Conduct Policy, Seller Guidelines and product-specific return terms. Applicable law controls any conflict; seller payment and operational issues are primarily governed by the Seller Agreement.

2. Accounts and eligibility

Users must provide accurate information, protect credentials and be legally able to transact. Minors may participate only as permitted by law and with appropriate parent or guardian involvement. Cross Your Arts may restrict accounts or refuse service for lawful reasons, including fraud, safety or policy violations.

3. Independent sellers and product listings

Unless expressly identified otherwise, products are sold by independent Sellers, who are responsible for their descriptions, pricing, product safety, availability, shipping, customer support and lawful seller policies. Cross Your Arts provides marketplace technology, payment facilitation and support, but does not manufacture or independently warrant third-party products.

Listings may be removed for violations or safety concerns. Seller approval does not guarantee product quality, safety or compliance. Buyers should read listing details and contact sellers through marketplace messaging with questions.

4. Ordering, payments and marketplace communications

Marketplace orders must be placed and paid through the Cross Your Arts checkout. Buyers should not pay sellers outside the platform for marketplace-related orders. Payment processing is handled by Stripe and other disclosed providers, whose applicable terms may also govern. Any Seller payment-processing fee is handled under the Seller Agreement and is accounted for from the Seller-funded reserve; it is not added as a separate fee to the buyer’s checkout total.

Orders may be declined or canceled for availability, errors, fraud, failed payment or legal reasons, with applicable refunds processed as required. Each Seller fulfills its own products. Items may ship separately and may have different processing and delivery timelines as disclosed at checkout. Checkout will show how each purchase is structured.

5. Prices, shipping and taxes

Checkout should display merchandise prices, shipping charges, applicable taxes and other charges before purchase. Sellers are responsible for accurate listings and disclosed shipping terms. Shippo may support shipping rates, labels and tracking; carrier transit times are estimates unless guaranteed under applicable terms.

Cross Your Arts collects, reports and remits sales tax on marketplace orders delivered to jurisdictions where Cross Your Arts is registered or otherwise required by law to collect. Tax is calculated at checkout based on the delivery destination and the accurate product tax code assigned to the listing, as required by law. Cross Your Arts has Michigan nexus and is responsible for Michigan sales tax on orders delivered to Michigan. The Michigan sales tax license is approved, and Michigan collection will be active in Stripe Tax before marketplace launch. Cross Your Arts will collect and remit Michigan sales tax on Michigan-destination orders from launch. Cross Your Arts maintains a current list of its registered or required-to-collect states in the Seller FAQ. Until Cross Your Arts is registered or otherwise required by law to collect in a jurisdiction, Sellers are responsible for sales tax on marketplace orders delivered to their home state and any other jurisdiction where they have their own legal obligation to collect or remit sales tax. Sellers must assign an accurate product tax code to every listing. Sellers may not add or separately charge sales tax on a Cross Your Arts marketplace order.

6. Returns, cancellations and refunds

Independent sellers set their own clearly displayed return, cancellation and refund policies for physical items, subject to consumer-protection law. Buyers should review those policies before purchasing and contact sellers through Cross Your Arts messaging for return requests, damaged items, non-delivery or incorrect goods.

Sellers may approve full or partial refunds through the marketplace. Cross Your Arts may review unresolved issues and facilitate or process authorized adjustments as permitted by law and marketplace policies. Refunds are funded from Seller funds; Cross Your Arts does not advance its own funds to cover them. Before a refund is initiated, the marketplace refund workflow checks whether sufficient Seller funds are available. If funds are insufficient, the request remains pending while the amount is recovered from the Seller, subject to applicable consumer-protection law and payment-provider rules. Approved refunds generally go back to the original payment method. Processing times vary by payment provider. Buyer refunds are not reduced to cover Seller processing fees.

Refund funding arrangements between Cross Your Arts and Sellers do not waive buyers’ statutory rights or applicable payment-network requirements. See the separate Customer Returns & Refunds Policy for procedural details.

7. Reviews, messages and acceptable conduct

Users must not post unlawful, fraudulent, harassing, misleading or infringing content, misuse reviews or messaging, solicit off-platform marketplace transactions or interfere with platform operations. Cross Your Arts may moderate content and accounts consistent with law and policy.

8. Privacy and data

The Privacy Policy explains the handling of account, seller-application, order, payment-related and shipping information. Stripe, Sharetribe, Render, Shippo, SendGrid and other disclosed providers may process information as necessary to operate services. Sellers must use buyer information only for authorized order and legal purposes.

Account deletion may be subject to retention of records required for tax, legal, dispute-resolution or operational obligations. Users may contact contact@crossyourarts.com for marketplace support and privacy requests, subject to the published Privacy Policy.

9. Intellectual property and promotions

Users retain ownership of content they lawfully submit, while granting Cross Your Arts rights reasonably needed to display listings and operate the service. Seller promotional permissions are addressed separately in the Seller Marketplace and Marketing Agreement. Users must not upload materials they lack permission to use.

10. Service availability and enforcement

Features may change, experience outages or be limited for maintenance or legal reasons. Cross Your Arts may investigate suspected fraud or violations, remove content, restrict accounts and cooperate with lawful requests. Outstanding transactions and mandatory legal rights are not extinguished by account closure.

11. Disclaimers, disputes and applicable law

Nothing in these Terms is intended to exclude rights that cannot legally be waived.

12. Changes, contact and effective date

Cross Your Arts may update these Terms with notice and renewed acceptance where legally required. The effective and last-updated dates for this version are stated below.
